Terms and Conditions of Sale
This English version is provided for information purposes only. In case of any discrepancy, the French version prevails and is the legally binding one.
1. Purpose and identification of the seller
These general terms and conditions of sale (hereinafter "T&Cs") govern the contractual relations between:
Alex Gab, painter, residing in Paris, reachable at contact@alexgab.fr (hereinafter "the Artist"), and any adult, non-merchant natural person (hereinafter "the Buyer") purchasing an original artwork via the alexgab.fr website.
VAT not applicable, article 293 B of the French General Tax Code.
2. Acceptance of the T&Cs
Any order placed on the website implies the Buyer's full and complete acceptance of these T&Cs. The applicable T&Cs are those in force on the date the order is validated.
3. Artworks offered
All artworks presented on the website are original and unique creations. Once sold, an artwork is no longer available. Photographs of the artworks are as faithful as possible, but a perfect resemblance cannot be guaranteed, in particular because of how colours render on screen.
4. Prices
Prices are indicated in euros, all taxes included (VAT not applicable, see article 1). Shipping costs are calculated according to the size of the artwork and the chosen shipping method, and are shown to the Buyer before the final validation of the order.
The Artist reserves the right to cancel any order in the event of an obvious pricing error or unavailability of the artwork (theft, damage, prior sale not yet recorded). In such a case, the Buyer is informed without delay and fully refunded.
5. Order process
The order is placed through the following steps: selection of the artwork, choice of shipping method, basket validation, entry of contact details, online payment. The sales contract is formed upon payment confirmation. A confirmation email summarising the order is sent to the Buyer.
6. Payment
Payment is made online by credit card via Stripe, a secure provider compliant with PCI-DSS standards. No banking data is stored by the Artist.
7. Delivery
Artworks are shipped rolled in a cardboard tube by default. The Buyer may opt for stretched-on-frame delivery (paid option) or for in-person pickup by appointment.
Estimated delivery times: 5 to 10 working days within metropolitan France, 10 to 20 working days internationally, from the date of payment confirmation.
8. Transfer of ownership and risks
Ownership of the artwork is transferred to the Buyer after full payment of the price has been received. Transport-related risks (loss, damage) are transferred to the Buyer upon actual delivery of the artwork.
9. Receipt and artworks damaged in transit
The Buyer must check the condition of the parcel and the artwork upon receipt, in the presence of the carrier whenever possible. In the event of damage or missing items, the Buyer must:
- issue precise, dated and signed reservations on the delivery slip with the carrier;
- inform the Artist by email at contact@alexgab.fr within 3 working days of receipt, attaching photographs of the parcel and the artwork, and keeping the original packaging.
Failing to follow this procedure, no compensation may be claimed in respect of transport.
10. Right of withdrawal
In accordance with article L221-18 of the French Consumer Code, the Buyer has 14 days from receipt of the artwork to exercise their right of withdrawal, without having to justify any reason.
To exercise this right, the Buyer notifies their decision to the Artist by email at contact@alexgab.fr, before the deadline expires, through any unambiguous statement.
The artwork must be returned in its original condition, in its original packaging, within 14 days of the withdrawal notification. Return shipping costs are borne by the Buyer. It is strongly recommended to ship the return with insurance and tracking; the Buyer remains responsible for the artwork until it is received by the Artist.
The refund is issued no later than 14 days after receipt of the returned artwork, or from the date of proof of dispatch by the Buyer if earlier, using the same payment method as the original order.
11. Legal warranties
Independently of the certificate of authenticity provided with each artwork, the Buyer benefits from the following legal warranties:
- the legal warranty of conformity (articles L217-3 et seq. of the French Consumer Code), allowing the Buyer to obtain conformity of the goods in case of a defect existing at delivery, within 2 years;
- the warranty against hidden defects (articles 1641 et seq. of the French Civil Code), allowing the Buyer to obtain a refund or price reduction in case of a hidden defect rendering the goods unfit for use, within 2 years from the discovery of the defect.
12. Certificate of authenticity
Each artwork is delivered with a certificate of authenticity signed by the Artist, mentioning the title, dimensions, technique and year of creation.
13. Personal data
Personal data collected in the context of the order is processed in accordance with the privacy policy available on the alexgab.fr website.
14. Modification of the T&Cs
The Artist reserves the right to modify these T&Cs at any time. The T&Cs applicable to an order are those in force and accepted by the Buyer at the time the order is placed.
15. Applicable law and competent jurisdiction
These T&Cs are governed by French law. Failing an amicable resolution, any dispute will be brought before the competent courts of Paris.
